Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and Focus Jungle ("Focus Jungle," "we," "our," or "us") and govern your use of the Focus Jungle website, app, and related services (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age in your country) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian. By using the Service you represent that you meet these requirements.
2. Your account
You are responsible for the activity on your account and for keeping your sign-in credentials secure. Notify us promptly at [email protected] if you suspect unauthorized access. You agree to provide accurate information and to keep it up to date.
3. Acceptable use
You agree not to:
- Use the Service to violate any law, infringe intellectual property rights, or harass, threaten, or harm another person.
- Reverse engineer, scrape, or attempt to gain unauthorized access to our systems or to the data of other users.
- Interfere with or disrupt the Service, including by introducing malware, abusing rate limits, or running automated tools that exceed normal usage.
- Misrepresent your identity, impersonate other users, or create accounts to evade enforcement actions.
- Manipulate leaderboards, focus battles, achievements, the coin economy, or any other competitive feature.
We may investigate and take appropriate action - including warnings, feature limits, account suspension, or termination - against any use we reasonably believe violates these Terms.
4. Your content
You retain ownership of the content you create or upload through the Service (such as session notes, plans, tags, and display name). By making content available through the Service you grant us a worldwide, royalty-free license to host, store, reproduce, display, and otherwise use that content solely to operate, improve, and provide the Service to you and the people you choose to share it with.
5. Subscriptions, coins, and payments
Some features and digital items require payment. Payments are processed by Stripe and are subject to Stripe's terms in addition to ours.
- Subscriptions. Premium subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled before renewal. You can cancel at any time from your account settings; cancellation takes effect at the end of the current period.
- Coins and digital items. Coins, plants, themes, icons, sounds, and similar items are non-transferable digital goods that exist only inside the Service. They have no real-world monetary value and cannot be exchanged for cash.
- Refunds. Except where required by applicable law, all purchases are final and non-refundable. We may grant refunds at our discretion (for example, for duplicate charges or items you did not receive).
- Taxes. Prices may exclude applicable taxes, which are added at checkout where required.
- Price changes. We may change prices for new billing periods. We will give reasonable notice before any change takes effect for an existing subscription.
6. Service availability and changes
We are continuously improving Focus Jungle and may add, change, or remove features at any time. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.
7. Termination
You may stop using the Service at any time by deleting your account from the in-app settings. We may suspend or terminate your account if you violate these Terms, if required by law, or if continued provision of the Service to you is no longer commercially reasonable. On termination your right to access the Service ends; sections of these Terms that should survive (including ownership, disclaimers, and limitations of liability) will survive.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content, data, or focus session record will be preserved without loss.
9. Limitation of liability
To the fullest extent permitted by law, Focus Jungle and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid Focus Jungle in the twelve (12) months before the event giving rise to the claim, or (b) USD 50.
10. Indemnification
You agree to indemnify and hold harmless Focus Jungle and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in Delaware, unless applicable law in your jurisdiction prevents this.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will revise the "Last updated" date above and, if appropriate, notify you in-app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
